In Russia, there are several ways to become the owner of an apartment: buying and selling, getting a mortgage, receiving it as inheritance. However, according to aif.ru, it is not always possible to sell such real estate without loss.

“Yes, it is possible to sell an apartment immediately after receiving it as a gift. As a rule, the gift agreement does not contain restrictions on the recipient’s rights to dispose of the acquired apartment,” explained Oksana Vasilieva, a candidate of legal sciences, associate professor of the Financial University under the Government of the Russian Federation. – “Current legislation does not require notifying the donor of transactions for the disposal of the apartment. But remember that when selling the apartment immediately after the agreement comes into legal force, you will have to pay personal income tax. The Tax Code establishes a minimum threshold for owning an apartment – 5 years.

If you own an apartment for more than 3 years and the property right arose from a gift agreement from a family member or close relative, and you decided to sell it, then in this case you do not need to pay tax. If you own the apartment for less than the specified period, then the income from the sale is subject to personal income tax in accordance with the established procedure.”
